Jockey Chad Schofield will seek a stay of proceedings through the Victorian Civil and Administrative Tribunal (VCAT) on Friday.
Schofield had lodged an appeal with VCAT against the severity of the 32-meeting suspension for improper riding handed out at Mornington on September 17 and sought a stay of proceedings which was opposed by Racing Victoria stewards.
VCAT was unable to hear Schofield's appeal until the week beginning October 13 with his suspension due to end at midnight on October 17.
An appeal by Schofield to the Racing and Disciplinary Board against the severity of penalty was dismissed last week.
