Nikolic seeks further review

Friday 12 July 2013, 6:09pm

The Danny Nikolic disqualification saga is set to be revived in the Victorian Civil & Administrative Tribunal (VCAT).

Nikolic has lodged an application with VCAT for a review of two decisions of the Racing Appeals and Disciplinary (RAD) Board relating to alleged incidents involving stipendiary steward Wade Hadley.

The RAD Board last month rejected Nikolic's argument that it did not have the right to hear the charges laid against him on the grounds he was no longer a licensed person.

Nikolic maintained that the RAD Board therefore had no jurisdiction over him.

He also wants a VCAT review of the RAD Board decision to reject his claim that he would be denied procedural fairness if that board heard the charges.

Nikolic is charged with two counts of improper conduct following incidents during a VCAT hearing in which he allegedly approached Hadley and made aggressive comments toward him.

The RAD Board had earlier disqualified Nikolic for two years over a threat he made against Victoria's chief steward Terry Bailey at a Victorian race meeting last September.
